INFORMATION MEMORANDUM

TO:    STATE AGENCIES ADMINISTERING OR SUPERVISING THE ADMINISTRATION OF TITLE IV-E OF THE SOCIAL SECURITY ACT

SUBJECT:    P.L. 99-177, the "Balanced Budget and Emergency Deficit Control Act of 1985" ("Gramm-Rudman-Hollings")

LEGAL AND RELATED REFERENCES:    Public Law 99-177, section 256(f) and ACYF-PI-86-01

BACKGROUND:    During its ninty-ninth session, Congress enacted P.L. 99-177, the "Balanced Budget and Emergency Deficit Control Act of 1985," (popularly known as the "Gramm-Rudman-Hollings Law"). In that act, the Congress enacted a specific provision applicable to Title IV-E-Foster Care and Adoption Assistance. At the time ACYF-PI-86-01 was issued, it was not known whether or not the provisions of P.L. 99-177 would apply to fiscal year 1987.

INFORMATION:    Congress has determined that it has met the requirements of P.L. 99-177. Therefore, section 256(f), which would limit rate increases, does not apply to expenditures made in Federal fiscal year 1987.
