INFORMATION MEMORANDUM

TO:   State Agencies Administering or Supervising the Administration of Title IV-E of the Social Security Act; and State Independent Living Program Coordinators

SUBJECT:   Availability of FY 1999 Funds for the Independent Living Program

LEGAL AND RELATED REFERENCES:   Sections 472, 474, 475 and 477 of Title IV-E of the Social Security Act; ACYF-PI-93-16 dated December 10, 1993; and the Omnibus Budget Reconciliation Act of 1993 (P.L. 103-66).

PURPOSE:   The purposes of this Information Memorandum are to: (1) inform States that FY 1999 Independent Living Program (ILP) funding is available; (2) inform States of the procedures to be followed in applying for FY 1999 ILP funds and in reporting on program activities and services; and (3) inform States that ILP information must be included in the Child and Family Service Plan (CFSP).

INFORMATION:

FY 1999 Application Procedures:   The instructions provided by Program Instruction ACYF-PI-93-16 dated December 10, 1993 (Attachment A) remain in effect and must be followed in order to receive FY 1999 ILP funds.

Availability of Funding:For FY 1999, the amount appropriated is $70 million. The FY 1999 State allotment table, which includes both the basic amount and the additional amount of Federal funds available to be matched with State funds, is attached (Attachment B). FY 1999 funds must be liquidated by September 30, 2000.

Application and Reporting Procedures:    The ILP applications are due to the Administration for Children and Families (ACF) Regional Offices not later than January 31, 1999 and a courtesy copy should also be mailed to:

If a State submitted its ILP application for FY 1999 as part of the Annual Progress and Services Report (APSR) on June 30, 1998, and it has been approved for funding, the State is not required to submit an application by January 31, 1999.

The ILP Program Reports must still be submitted not later than January 1 of the year following the end of the fiscal year for which funds were awarded. Please send copies to the ACF Regional Office and the ChildrenÂ’s Bureau (see above address).

Content of CFSP:   A description of the Independent Living services to be provided in FY 2000 must be included in the CFSP regardless of whether a State applies for funds in January or did so in June. States may elect to consolidate the ILP application information into the CFSP final report for FY 2000 and into the Annual Progress and Services Reports for FY 2001 – 2004.

If they decide to do so, the requirements for ILP funding as outlined in ACYF-PI-93-16 must be included in the CFSP or APSR.
