Texas' comments on State data presented in Child Welfare Outcomes 2001: Report to Congress are the following:

The numbers in each table appear to be accurate with the exception of item B. (NCANDS), Age of Child Victims for 2000, which shows 10.8% Unknown. This is an aberrant percentage compared with 98', 99' and 2001 (0 - 0.1%). The 2000 file that we submitted contained 656 records out of 171,641 with no valid age. The file used by NCANDS for publication has 22,538 out of 171,641. We also looked at 2001 data and the accepted file has 754 out of 197,274. The only thing we can say in response is that the data published for 2000 do not match the information that the state submitted.

The data for outcome measure 3.1, 3.2, and 3.3 indicate a substantial percentage of missing data with respect to "reason for discharge" information reported to AFCARS. Our response to this issue is that a very high number of children aging out of care during these years is missing a "reason for discharge". This field is not required in CAPs, but will be required in IMPACT beginning 9/1/2003. A significant proportion of the missing data would be present if the field could be mapped to a default AFCARS code, but we have been advised against this by the Children's Bureau.

The data for outcome measure 3.4 indicate that 50.2 percent of children emancipated from foster care in FY 2001 were age 12 or younger at the time of entry into foster care. The national median for this measure is 28 percent. Our response is as follows: the data in 3.4 cannot be considered reliable due to the problem identified in the response to 3.1, 3.2, and 3.3 above. The high number of cases without a reason for discharge renders the percentage unreliable. However, this data problem will resolve itself when Reason for Discharge becomes a required data entry field in September 2003.

Finally, with regard to the Outcomes Data for Texas, we would prefer that the first two rows under 2.1 Maltreatment in Foster Care be reversed. Currently, the order of these rows is as follows: "Children Maltreated while in foster care" is the first row, and "Children not maltreated while in foster care" is the second row. We are requesting that the order be as follows: "Children not maltreated while in foster care" as the first row, and "Children maltreated while in foster care" be the second row. This would provide parallel construction with the rows under 1.1 Recurrence of Maltreatment Within 6 Months.

Texas [ Federal Comment ]

The following discussion focuses on Texas' performance with regard to each of the outcomes assessed in the Child Welfare Outcomes Annual Reports to Congress. The Texas Child and Family Services Review (CFSR) was completed in fiscal year (FY) 2002, and compliance with the national standards was based on data from 2000. The final report for that review is available from Reports and Results of the Child and Family Service Reviews (CFSRs) . A discussion of the implications of CFSR findings for Texas' performance on the Report to Congress Outcomes is provided in Child Welfare Outcomes 2000.

The State's performance is assessed by examining the percent change in the data for each outcome measure from 1999 to 2001. The percent change was calculated using data carried out to the second decimal point. However, with the exception of outcome measure 2.1, the data presented in the Report to Congress are rounded to one decimal for ease of reading the tables (measure 2.1 must be presented as two decimals because the national standard is less than one percent).

Outcome 1. Reduce recurrence of child abuse and/or neglect
In calendar year (CY) 2001, the rate of maltreatment recurrence within 6 months was 4.2 percent, which is lower than both the national standard of 6.1 percent or less and the national median of 8.0 percent. Texas' performance on this measure did not change substantively from 1999 to 2001.

Outcome 2. Reduce incidence of maltreatment in foster care
In CY 2001, the incidence of maltreatment in foster care was 0.3 percent, which is lower than both the national standard of 0.57 percent or less and the national median of 0.47 percent. Texas' performance on this measure declined slightly from 1999 to 2001 (+6.2 percent change).

Outcome 3. Increase permanency for children in foster care
In FY 2001, 76.9 percent of children exiting foster care were discharged to permanent homes, which is less than the national median of 84.7 percent. However, it is not possible to assess State performance on this outcome because "reason for discharge" information was not provided to the Adoption and Foster Care Analysis and Reporting System (AFCARS) for 18.8 percent of the children exiting foster care during FY 2001. In addition, discharge reasons were not provided for 19.7 percent of the children with a diagnosed disability who exited from foster care, or for 54.8 percent of children who exited from foster care who were older than age 12 at the time of entry into foster care. The State's comment letter notes that many of the children with a missing "reason for discharge" were discharged to emancipation.

Outcome 4. Reduce time to reunification without increasing re-entry
In FY 2001, the percentage of all reunifications occurring within 12 months of a child's entry into foster care was 60.7, which is lower than both the national standard of 76.2 percent or more and the national median of 69.2 percent. According to information provided in the CFSR Final Report, the State believes that performance on this measure is due to the agency's practice of maintaining legal custody of a child for 3 to 6 months after physical reunification to continue monitoring the family and to support children's safety. There was no substantive change overall from FY 1999 to FY 2001.

The State's performance with regard to reunification within 12 months must be balanced by the finding that in FY 2001, the percentage of children re-entering foster care within 12 months of discharge from a prior foster care episode was 2.7, which is considerably lower than both the national standard of 8.6 percent or less and the national median of 10.4 percent. Despite very good performance on this measure, there was a decline from FY 1999 to FY 2001 (+105.6 percent change).

Outcome 5. Reduce time in foster care to adoption
In FY 2001, the percentage of all finalized adoptions occurring within 24 months of a child's entry into foster care was 51.3, which is higher than the national standard of 32.0 percent or more and the national median of 21.0 percent. Texas' performance on this measure exhibited continuous improvement from FY 1999 to FY 2001 (+41.3 percent change).

Outcome 6. Increase placement stability
In FY 2001, the percentage of children in foster care for less than 12 months who experienced no more than 2 placements was 71.0, which is lower than the national standard of 86.7 percent or more and the national median of 83.3 percent. There was no substantive change in performance on this measure from FY 1999 to FY 2001.

Outcome 7. Reduce placements of young children in group homes and institutions
In FY 2001, the percentage of children age 12 or younger placed in a group home or institution was 12.1, which is higher than the national median of 8.7. There was no substantive change in performance on this measure from FY 1999 to FY 2001.
