45 CFR 1355.40(a) Scope of
the data collection system - foster care

responsibility for placement, care, or supervision (45 CFR
1355.40(a)(2)). |

section 422(b)(10) of the Social Security Act (the Act) (Appendix A
- SECTION II).
|
Yes |
blank cell |
- All children supervised by or under the responsibility of
another public agency with which the title IV-B/E agency has an
agreement under title IV-E and the State makes title IV-E foster
care maintenance payments (Appendix A - SECTION II).
|
The State is including the juvenile justice
population that is covered under title IV-E for reimbursement. The
State does not have title IV-E agreements with Tribes. |

children covered under section 422(b)(10) of the Act, (45 CFR
1355.40(a)(2)). |

| Includes all children who
have been in foster care at least 24 hours (Appendix A - SECTION
II). |
According to the State team, children that have
been removed for more than 24 hours are included in the AFCARS
population. State needs to verify that this is the case and ensure
that it is in the new extract code. |
blank cell |
| Does not include children who
are in their own homes under the responsibility of the State agency
(Appendix A - SECTION II). |
The State does not report on children unless
they have been placed in out of home care. |
blank cell |
| Include all children who are
in the placement, care, or supervision responsibility of the title
IV-B/E agency that are on "trial home visits". (Child Welfare
Policy Manual, section 1, AFCARS.) |
The State is not extracting the foster care
population as defined by AFCARS. The State considers a case as
being discharged when the child returns home, even if the State
retains care and custody. For AFCARS purposes, these cases should
still be reported in the foster care data file. A child who returns
home, while the State retains placement, care or supervision,
should continue to be included in the AFCARS report as a child in a
"trial home visit" placement setting (element #41). The date that
the trial home visit begins should be entered as the current
setting placement date (element #23), but the number of placement
settings (element #24) should not change. |
blank cell |

State has placement and financial payment responsibility for, but
the State does not have custody (ACYF-PIQ-95-01, 3/8/1995). |

provides education and support services up to age 23. |
