DC-90-27 (Proposed Rulemaking)
TO ALL STATE IV-D DIRECTORS
Dear Colleague:
On August 15, 1990, we published a Notice of Proposed Rulemaking (NPRM) in the Federal Register (55 FR 33414) to implement provisions of the Family Support Act of 1988 (P.L. 100-485) for immediate wage withholding, review and modification of support orders, and notice of assigned support collected. In part, the proposed regulation, at õ303.8, would require the State to implement procedures for the periodic review and modification of IV-D support orders. Section 303.8(d) would require notification of both absent and custodial parents: (1) that they have the right to request a review of the support order; (2) that a review will occur; and (3) that a modification is being proposed or a determination has been made that there should be no change in the order and that they have a right to initiate proceedings to challenge the modification or determination.
We have received many questions regarding the effective date for the notification requirements, in particular regarding the right to request a review of the support order. We wish to clarify that the effective date for the notification requirement for the right to request a review is October 13, 1993, or such earlier date as the State may select. We hope this clarification is helpful.
