Re: Status of Federal/State Welfare Reform Work Groups -- September 1997

Dear Colleague:

I am pleased to send you this report updating activities of our work groups through September 30, 1997. We distributed the May 1997 update at the NCSCSEA meeting in Des Moines, May 1997.

As you will see from the milestones and results reported for each group, much has been accomplished through our federal/state partnership during the past fiscal year. Membership in the groups was based on information in early September. Changes may have occurred since which will be shown in our next update. Future updates will list period-to-date accomplishments and plans and reflect changes as new work groups are added and others removed as they complete their charter.

Thank you for a very productive year as we look forward to a year with even more accomplishments.

APPENDIX: STATES BY FEDERAL REGION

1. EXPANDED FPLS WORK GROUP

Purpose:

To assist OCSE in establishing the National Directory of New Hires and the Federal Case Registry. The work group will explore such topics as the creation of reporting procedures, communications linkages, internal files, and matching and notification procedures which will result in the transmission of state New Hire Data and Case Records to the national directory of New Hires and Federal Case Registry, respectively.

Milestones:

The Expanded FPLS Work Group met in September and December 1996, and in March and May 1997. There are meetings planned for October and November. Among the accomplishments:

o Assisted in reviewing high level systems requirements for the National Directory of New Hires (NDNH) and the Federal Case Registry (FCR).

o Assisted in planning and presenting at the December conference, "New Hire Reporting at the State and Local Level: Making It Work."

o Assisted in planning and presenting at the September Seventh Annual OCSE Training Conference.

o Assisted in presenting at the May ACF Systems Users Group meeting. Scheduled to assist in November meeting.

o Provided input to OCSE staff on employer outreach.

o Provided materials included in the OCSE publication, "Employer New Hire Reporting: A Guide to Implementation."

o Assisted in developing an OCSE video on new hire reporting. o Sent Work Group proceedings to IV-D Directors for review.

Next Steps:

A subgroup of the Expanded FPLS Work Group will meet in October to further refine design issues for the FCR which will be presented to the work group in November.

2. INCENTIVE FUNDING WORK GROUP

Purpose:

To reach consensus on a new incentives scheme in time to meet requirements in PRWORA to submit a report to Congress by March 1, 1997.

3. REGULATION REINVENTION WORK GROUP

Purpose:

To review existing regulations, examine the extent to which they are mandated by law, or are a result of secretarial authority to issue rules where necessary; decide which ones to remove/clarify, and decide what type of policy guidance should be issued regarding welfare reform legislation; examine which regulations are impacted by legislation.

Milestones:

o Met via monthly conference calls October 1996 through March 1997. First made two decisions: 1) decided to have a co-coordinator; and 2) decided our project would be to review the regulations against PRWORA and remove or revise those regulations which are obsolete or inconsistent. Then the work group completed reviewing 45 CFR 301 and continued reviewing 45 CFR 302.

o Met April 1 through 3, 1997 in Washington, DC and completed reviewing 45 CFR 302, 303, 304 and 305.

Next Steps:

o Revise notes from the April 1997 Conference.

o Draft Omnibus Conforming NPRM to assure the CFR is consistent with PRWORA by considering the revisions suggested by the work group.

o Meet via conference call in the Fall to decide our next project.

4. INTERSTATE (UIFSA) WORK GROUP

Purpose:

To address several transitional aspects as states move from URESA to UIFSA. Subcommittees have met as needed to discuss necessary UIFSA adoptions to the Interstate Roster and Referral Guide (IRG), a handbook for caseworkers, new standard interstate forms, and automation concerns associated with new forms. Two of the subcommittees have completed their work -- training and implementation and the development of the handbook.

Milestones:

o OMB approved the new standard UIFSA forms.

o OCSE is providing training on the use of the UIFSA forms at regional and national conferences.

IRG Subcommittee Update:

o Updated the 1996 Version of the Roster with approximately 24 additional elements and changes relative to UIFSA and the Full Faith & Credit Act.

o Developed matrices and maps which outline the states' UIFSA implementation status. To date, there are 35 (includes DC) states who have adopted UIFSA.

o Made accessible the State Profiles and the UIFSA matrix via the ACF BBS (800-627- 8886) and Internet. The internet address to access the data is:

http://www.acf.hhs.gov/ACFProgram/CSE/

The profiles are available on disk in WP5.1 format upon request from Hope Butler, OCSE, on (202) 401-5466.

Plans:

o Future Electronic Access Plan: OCSE Central Office staff are researching avenues that will allow states to update their profiles as states' laws and procedures change. Also, other states will be able to access and obtain the information more often than annually.

o The next profile update is tentatively scheduled for Spring 1998.

o The IRG Work Group will serve as the resource to resolve some of the FIPS problems which affect the operation of the IRG/CSENet systems.

Automation Subcommittee Update:

o Refocusing efforts to explore PC-based and client-server-based options after a mainframe-based format proved cost-inefficient.

o Examining feasibility of: transferring Texas' forms automation module for nation-wide use; having the CSENet contractor create the necessary macro files for the UIFSA forms in Microsoft Word 6.0, and possibly in WordPerfect 6.0; other forms of automation such as JetForms.

5. CUSTOMER SATISFACTION WORK GROUP

Purpose:

To develop strategies to improve service to our customers. Customers include those we deal with directly in our business, including custodial and noncustodial parents. Customers also include child support enforcement staff, whether at the federal, state or local level. Improving customer service is expected to improve our program outcomes, such as increasing collections, etc.

Indicator 1:Children First Survey

State and federal work group partners have developed a survey instrument for state use in assessing the satisfaction of their custodial and noncustodial customers with services. The instrument can be tailored by states to their specific needs and is entirely voluntary. A related effort, being carried out under contract and now in its information gathering stage, is concerned with the development of a nationally representative CSE customer service survey.

Status:

The work group developed survey questions that are being field tested in Fairfield and Cuyahoga Counties in Ohio and in Hennepin County, Minnesota. Ohio, as part of a larger staffing study, also is including customer service questions using the work group's instrument. Region VII states have plans for field testing this fall. Other states have indicated interest in testing parts of the survey: Delaware, Iowa, Massachusetts, New Hampshire, Texas, and Washington State. Arizona also has developed a customer satisfaction survey which has been field tested.

A contract with the Urban Institute was awarded. This project will assess the feasibility of developing and conducting a nationally representative CSE customer service survey. It includes a literature review (completed) and visits to states that have conducted customer satisfaction surveys. It will also look at how to select a nationally representative sample of CSE customers. If such a survey is determined to be feasible, design, development, and testing of a questionnaire would be carried out under a separate contract--funds permitting.

Indicator 2:Survey of State Child Support Enforcement Program's satisfaction with federal performance

This survey will address such things as unnecessary regulations, technical assistance, training, FPLS, etc. The survey would be jointly developed by federal and state partners. While the survey will be sent to state IV-D directors, staff-level and local office input should be considered in responding to survey questions.

Status:

The HHS Inspector General began its survey activities in September.

6. INCOME WITHHOLDING FORM WORK GROUP

Purpose :

To facilitate the use of the standardized form by working with State Child Support Enforcement Agencies and employers' payroll administrators.

Results :

o OMB granted emergency approval for the Order/Notice to Withhold Income for Child Support (standardized income withholding form) through October 31, 1997. Final approval on the Order/Notice is expected by 10/97.

o Distributed Action Transmittal 97-03, dated March 6, 1997. Additional copies are available by contacting Dianne Offett at (202) 401-5425.

o We are responding to comments regarding minor revisions to the Order/Notice.

o States are using the Order/Notice for interstate income withholding.

o OCSE is providing training on the use of the Order/Notice at regional and national conferences.

7. DISTRIBUTION WORK GROUP

Purpose :

To determine how to do distribution under the welfare reform statute.

Milestones/Next Steps:

o AT addressing distribution requirements, giving answers to questions received to date, and giving case scenarios illustrating appropriate distribution of collections, will be issued before the end of October.

o To explore issues around state option to continue current distribution in former assistance cases until September 30, 1998 and implement FY 2000 changes October 1, 1998; address additional questions on AT once issued; and continue roll-out and training.

8. NATIONAL CHILD SUPPORT ENFORCEMENT TRAINING WORK GROUP

Purpose:

As a collaborative effort with the child support community, to develop a national strategy for meeting our diverse training needs in order to improve child support enforcement program results and customer services at the federal, state and local level. This strategy supports the mission of the Child Support Enforcement Program - to improve the lives of America's children.

Results/Plans:

We met in person for the second time this year in Alexandria, VA, following the 7th National CSE Training Conference in September, 1997 and re-organized the subgroups as follows:

1. Marketing/Public Relations - This group will elevate the work group's visibility. Subgroup members will address public relations for the new Electronic Resource Center by developing pamphlets, news articles for the OCSE newsletter, and desk aids with the Electronic Resource Center's e-mail address.

2. Training and Curriculum - This group will make working with the contractor on the Distance Learning interagency agreement their priority. Subgroup members will evaluate the training curriculum that will be considered for conversion to CBTs. They also indicate that they will re-examine the Needs Assessment Results to identify key training.

3. TechnologyThis group will develop a web page for the National CSE Training Work Group. They will look into what should go on the web page, and who will have access to it. The subgroup members will work closely with the Marketing/Public Relations Subgroup on this activity. In addition, the Technology Subgroup would like to design two satellite training events this year. The subject matter would be determined at a later date.

4. Coordination - This subgroup was eliminated because their function will be taken over by the subgroup chairs.

5. Indexing - This subgroup was eliminated because they have met their goals with the awarding of the Electronic Resource Center contract.

Our next face-to-face meeting will be held in January, 1998 in Alexandria, VA. We also are planning a work group conference call for November, 1997. At that time we plan to discuss the agenda for the January meeting, review our ground rules, discuss our participation in the 8th National Conference Planning meeting, review our membership list, and be updated on the interagency agreement with GS/USDA.

9. STATE INTERNAL SELF-ASSESSMENT WORK GROUP

Purpose :

To assist states in developing capability and a process for annual self-reviews and reports to the Secretary on their state programs required under Welfare Reform. These reviews would replace federal audits of state compliance with federal requirements. The work group will focus on providing technical assistance on organization, tools, techniques, corrective actions, and report content and objectives.

Milestones/Plans :

o After several conference calls between the members of the Self-Assessment core group, members held their first group meeting in Arlington, VA, May 21 through May 23, 1997. The result was a draft document sent to the members of the core group to be shared for comments with the other states in their region.

o Two additional core group conference calls were held to discuss and determine what form the work group's final product would take, and how the criteria to be reviewed document would be incorporated into that product.

o A second meeting was held in Denver, CO, August 12-14. During the meeting the core group: (1) developed a matrix to be used to conduct self-assessment reviews and a narrative description of the review requirements for the selected criteria; (2) agreed that federal OCSE staff would draft the report to the Secretary that would summarize the work group's activities, and (3) concurred that the review matrix, review requirements would be packaged as an Action Transmittal and submitted to the Secretary along with the Report to the Secretary.

The Matrix, Review Requirements, and Report to the Secretary have been drafted and are currently being reviewed by state representatives. Upon receipt and evaluation of their comments these documents will be finalized and submitted to the Secretary for review and approval.

10. SYSTEMS CERTIFICATION REQUIREMENTS WORK GROUP

Purpose :

To identify provisions of PRWORA96 that affect or create statewide automated Child Support Enforcement System [CSES] requirements and develop or revise CSES requirements as necessary. Revise the publication "Automated Systems for Child Support Enforcement: A Guide for States" [the Guide] to include PRWORA requirements. All revisions and new requirements not established by regulation will be incorporated in the Guide.

Milestones/Plans :

11. INTERNATIONAL CHILD SUPPORT WORK GROUP

Purpose :

To address issues surrounding international child support enforcement, to assist in defining the enhanced role of the U.S. central authority in HHS in facilitating international support enforcement cases, and to provide state input into U.S. federal declarations of UIFSA reciprocity status for foreign countries.

Milestones/Plans :

The work group has four subgroups, collectively called the "International CSE State Contact Group" (SCG), organized to assure state capacity in the area of international child support. SCG contacts were invited to comment on memoranda and to participate in a series of conference calls over the past months. Central among the SCG's tasks has been to identify and address the issues to be faced by state tribunals when working cases involving other nations, including the present status of state- level reciprocity declarations.

Another key task of the SCG has been to raise issues specific to individual nations with whom the U.S. is considering making a reciprocity declaration. SCG discussions on Ireland surfaced no problem issues regarding child support services provided to U.S. residents and subsequently Ireland became the first federal reciprocity declaration [42 USC 659A] nation effective September 10.

Over the next months, the SCG will continue to address development of uniform forms and procedures for international case processing and other common issues such as those related to international currency transfer, provision of services in "spousal support only" cases, and international acceptance of U.S. administrative orders.

12. PATERNITY ESTABLISHMENT WORK GROUP (PEW)

Purpose :

Provides a national focal point for state, regional, and federal efforts to increase paternity establishment for children born to unmarried parents. The work group will pay special attention to projects that: (1) support states' efforts to implement effective in-hospital and other early paternity acknowledgment programs; (2) help achieve the paternity establishment goals of the National Strategic Plan and (3) implement the paternity establishment provisions of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA).

Milestones/Plans :

o In May, task group submitted recommendations for minimum required elements for state paternity affidavits. Proposed elements published in Federal Register, 7/22/97.

o In Spring '97, work group members provided input to OCSE's draft NPRM for the paternity requirements of PRWORA.

o In April, June and August, PEW members helped develop and participated in 3 regional forums in Chicago, Atlanta, and Baltimore to raise issues and answers in voluntary paternity acknowledgement.

o In June, a task group developed proposal for national public information video on benefits, rights and responsibilities of establishing paternity, and four new outreach publications. Video will be contracted.

o In August, a task group started raising topics, identifying best practices and developing a matrix for state contacts in interstate case processing for paternity establishment. Materials will be part of companion reference to UIFSA guide and revised IRG.

o In September, a task group began collecting and analyzing agreements between state CSE and Vital Records agencies for purpose of identifying basic elements of good agreements; is also collecting best practices in CSE/VR relations/interface and clarifying FFP issues. Issuance to be developed.

o A task group is identifying and collecting examples of exemplary practices states are using to improve cooperation among TANF mothers and the existing CSE caseload in identifying the fathers of their children. Issuance to be produced.

o To share information about basic features of state paternity programs, a task group is reviewing and updating information contained in the 1994 OCSE publication, State Paternity Profiles: An Information Exchange to include salient paternity requirements of PRWORA, and other information.

o The work group will participate in generating critical feedback during the production process to OCSE's planned training video for health professionals on in-hospital paternity acknowledgement.

o The work group will be soliciting information from the states on the methods they are using to evaluate in-hospital paternity acknowledgement programs for the purpose of identifying and sharing effective evaluation tools and methods.

o The work group continues to submit to OCSE information on innovative practices in paternity establishment for inclusion in OCSE's Compendium of State Best Practices.

13. NATIVE AMERICAN WORK GROUP

Purpose :

To develop strategies to improve OCSE services to our Native American customers. To develop an action plan for Native American consultation. To provide suggestions to regions and states to improve Native American service levels. To develop materials and methods that Native American Tribes, groups, and organizations can utilize to access child support enforcement programs.

Results/Ongoing/Planned :

o Numerous activities have been discussed on the Native American conference calls and plans are under way for a general meeting in October.

o Under PRWORA, a draft consultation plan has been established to give Native Americans input prior to writing regulations.

o Participating in numerous conferences and provided technical assistance to numerous RO and CO staff, and Native Americans (Federally Recognized, State Recognized, urban and rural tribes and groups).

o Actively participating with other work groups to provide a Native American prospective.

o Participated in several National Native American conferences and activities to keep them informed of the latest events that could impact on their Tribes and tribal members.

o Provided lists of Tribes in each state and each region to all who have requested them.

o Working with all other Native American components in ACF and participated in conferences with TANF, CS, and Head Start as part of a cooperative agreement.

o Working with other OCSE staff to respond to various concerns, meet with Congressional staff and provide information to concerned constituents.

o Working with OCSE public affairs on publications and mailing lists specifically for Native Americans, states, and regional offices. Have direct input into the development of the Native American OCSE Handbook.

o A special OCSE Native American Directory -- "LINKS" -- is being established.

14. TECHNICAL ASSISTANCE WORK GROUP

Purpose:

Provides advice, feedback and suggestions to the OCSE Technical Assistance Branch (TAB) on the overall IV-D program's technical assistance needs and provisions to meet those needs. Serves as a facilitator among regional offices, central office, states and local partners to ensure effective working relationships. Performs work through its membership or through appointed subcommittees to fulfill the "Outcomes" specified in the TAB's Charter. Acts as a catalyst for continuous improvement in providing technical assistance.

Results:

o Developed comprehensive FY 97 national TA plan based on national needs survey.

o Approved a matrix of the assistance to be planned for at the national level to supplement regional technical assistance.

o The TAB has subsequently produced workplan matrices that were reviewed by the TAW that indicate the action item, the cost and the timeframes for delivery.

o As a result of TAB's responses to: 1) the national plan; 2) the TAW-created TAR (Technical Assistance Report, which is how states make a specific request for TA; 3) ad hoc requests; 4) initiatives by Regional Offices and other CO divisions; and 5) unsolicited proposals, the TAB is pursuing a multitude of TA projects to address state needs. Examples are the training and systems TA being developed for AZ regarding distribution, "one-state interstate" and in-hospital paternity retreats, working with OCSE's Division of Program Operations to expand the IRG (see "UIFSA" work group) and the Division of Policy and Program Evaluation on centralized collections.

Ongoing/Planned:

TAW's main role is to ensure that we stay on course by meeting the TA needs of states in a timely and appropriate manner. The needs assessment and plan rollup cycle will be restarted at the end of this fiscal year 98.

15. DEFINITIONS WORK GROUP

Purpose:

To establish definitions for various data elements needed for reporting. This will include revising/updating guidance on statutory reporting requirements, following up on the Measuring Excellence Through Statistics (METS) project, developing any definitions and guidance needed for the Strategic Plan outcome measures and expected incentive measures. The group will also assist OCSE in revising data collection forms.

Milestones:

Work group members have met three times thus far and a draft reporting form with instructions has been developed. The draft form will be submitted to OMB for approval early FY 98. Components of the group may assist ACF Office of Program Support with revising financial reporting forms.

16. CHILD SUPPORT ENFORCEMENT NETWORK (CSENet) TECHNICAL WORK GROUP

Purpose:

To assist states in implementing CSENet for interstate transactions by providing review and guidance on CSENet transactions and data elements, and by developing standards for interstate transmissions.

Subgoal 1

Assist states in making hardware interface Maintain and update status of hardware interfaces testing of products, instructions; proactively call states to inquire about status, offer assistance; provide TA at workshops, teleconferences.

o Users provided suggestions to the CSENet Technical work group for future technical needs including EFPLS queries, hardware and software needs New York, Florida and Utah presented papers on standardizing CSENet edits and errors

o The Requirements document and modifications to CSENet that are related to UIFSA have been disseminated to all states, so they can begin modifying their statewide automated CSE systems.

o CSENet software version regarding UIFSA currently being pilot tested by states. Implementation to all states scheduled in November-December 1997.

o Revisions to the CSENet Interface Guidance Document related to the CSENet UIFSA software version is currently being reviewed by the CSENet Technical Work Group.

o Copies of the valid transactions for CSENet have been disseminated to all CSENet point of contacts.

o Next CSENet workshop scheduled for November 6-7th in Topeka, Kansas.

o Delivery Order #7 related to CSENet software changes for Federal Case Registry and Quick Administrative Interstate Enforcement has been awarded. Discussions with the OCSE state/federal work groups on Case Registry and Quick Administrative Enforcement are planned in the next few months.

17. STATE DISBURSEMENT UNIT WORK GROUP

Phase One of Two

Purpose:

To enable the OCSE and the states to work together to address the problems associated with implementation of a state disbursement unit. states that have an operational state disbursement unit will provide guidance and advice to those states newly implementing their units. The group will undertake to assist OCSE in answering questions from the states on the state disbursement unit, developing a legislative implementation guide, and holding a forum on state disbursement unit issues.

Milestones:

o Held meeting in Denver, 6/30 - 7/2, to discuss questions submitted by states and to begin planning for a larger conference in December to include states not on the work group.

o OCSE Action Transmittal 97-13 published September 15, 1997, addressing policy questions submitted by states.
