RE: Final Report on State Child Support Enforcement Performance Penalties
Dear Colleague:
This memorandum transmits to you the Final Report on State Child Support Enforcement Performance Penalties. The Report was developed by a work group of Federal and State representatives who are listed at Attachment B. Performance penalties are required by sections 408(a) and 452 of Title IV-D of the Social Security Act. A brief summary of the Work Group's recommendations begins on page 1 of the Report.
Future regulations on performance penalties will take into consideration the recommendations of the State/Federal Work Group reflected in the Report. As you are aware, P.L. 105-200, the Child Support Enforcement Performance and Incentive Act of 1998, also requires OCSE to issue regulations on the new performance-based incentive system. OCSE plans to draft a combined Notice of Proposed Rule Making (NPRM) on incentives and penalties. The NPRM on incentives and penalties, to be published within 9 months of the enactment of P.L. 105-200, will afford a comment period.
