Preface

The following Office of Child Support Enforcement (OCSE) preliminary data report highlights financial and statistical achievements of the Child Support Enforcement program for fiscal year 1999. This report is a preliminary look at data that shows advancements made in the Child Support program in fiscal year 1999. The information is taken from State-submitted reports on program status submitted to OCSE quarterly or annually. The collections data are taken from form OCSE-34A and the expenditure data from the OCSE-396A. Fiscal year 1999 statistical data included in this report are taken from the new OCSE-157 report. States use this form to report caseload, orders and paternities established, medical support, staffing, and other statistical information to OCSE.

The new OCSE-157 reporting form includes much of the data found on the old statistical reporting forms, but adds new data reporting elements. In previous years the statistical information was collected by, TANF/FC, Non-TANF, and the Arrears categories. The information is now reported under the following categories: current assistance, former assistance, and never assistance. The definitions of these new categories can be found on page four of this report.

Due to the requirements of the new performance-based incentive funding system, the OCSE-157 also reflects several changes in the reporting definitions. Therefore, some of the FY 1999 data are not comparable to previous years’ data and in most cases five-year comparisons, shown in previous reports, are not made.

Federal auditors are in the process of assessing the completeness and reliability of State data. Many States have improved data reporting in anticipation of the data reliability requirements of PRWORA.

The following information is presented as reported by States and no assumption is made here concerning the reliability of the numbers.

Child Support Enforcement Background and Program Results

CSE Program Background

The Child Support Enforcement (CSE) program is a Federal/State/local partnership that establishes paternity and child support orders and collects child support. The program was established in 1975, a response by Congress to reduce public expenditures on welfare by obtaining child support from non-custodial parents on an ongoing basis, to help families to get support so they could get off and stay off public assistance, and to establish paternity for children born outside marriage so child support could be obtained for them.

Basic responsibility for administering the program is left to individual States, jurisdictions and local governments, but the Federal Government plays a major role in: dictating the major features of State programs; funding and providing technical assistance; and giving direct assistance to locating absent parents and obtaining support payments. While programs vary administratively from State to State, all programs locate non-custodial parents, establish paternity, orders and enforce orders through the collection and distribution of child support payments.

The CSE program continues to be strengthened through Federal and State statutory, regulatory and executive actions.

CSE Program Results for FY 1999

The following data tables provide preliminary financial and statistical information on the Child Support Enforcement (CSE) program for fiscal year 1999 and in some cases for the last five years. Table 1 provides national totals on child support collections, expenditures, program savings and cost-effectiveness for fiscal year 1999. Table 2 gives national statistics on the CSE caseload, cases with collections, percentage of cases with collections, cases with orders established, percentage of cases with orders established, percentage of cases with collections to cases with orders established, paternities established & acknowledged, and child support orders established for the same time period.

Readers should note that all numbers quoted are based on information supplied to the Office of Child Support Enforcement (OCSE) by the individual State CSE programs. Fiscal year 1999 data are preliminary as of June 30, 2000, and are subject to change.

During FY 1999, over $15.8 billion in child support payments were collected. Total caseload was almost 16.4 million. The CSE program had over 1.5 million paternities established & acknowledged and almost 1.2 million new child support orders were established in 1999.

Caseload. OCSE defines a child support case as a parent (mother, father, or putative father) who is now or eventually may be obligated under law for the support of a child or children receiving services under the title IV-D program. A "current assistance case" is a case where the children are: (1) recipients of Temporary Assistance for Needy Children (TANF) under title IV-A of the Social Security Act or (2) entitled to Foster Care maintenance under title IV-E of the Social Security Act. In addition, the children’s support rights have been assigned by a caretaker relative to the State and a referral to the State IV-D agency has been made. A "former assistance case" is a case where the children were formerly receiving title IV-A (AFDC or TANF) or title IV-E Foster Care services. A "never assistance case" is a case where the children are receiving services under the title IV-D program, but are not eligible for and have not previously received assistance under titles IV-A or IV-E of the Social Security Act. This includes cases where the family is receiving IV-D services as a result of a written application for IV-D services, including cases where children are receiving State (not title IV-E) foster care services or a case where they are Medicaid recipients not receiving additional assistance. There were over 16.4 million cases reported in fiscal year 1999.

There were almost 3.6 million current assistance cases, 6.8 million former assistance cases and 6 million never assistance cases reported in fiscal year 1999 (Table 2). Due to revisions in the reporting requirements the national caseload number has dropped, since last fiscal year. This is largely due to the elimination of the "arrears only category" which often reflected a duplicate case count. Cases are no longer counted or reported as arrears cases.

Paternities Established. When children are born out-of-wedlock establishing paternity is the first step for obtaining an order. Paternity establishment involves the legal establishment of fatherhood for a child. Paternity can also be established by a voluntary acknowledgement signed by both parents either as part of an in-hospital program or other acknowledgement programs. States must have procedures that allow paternity to be established at least up to the child’s eighteenth birthday. Child support IV-D caseload paternities were established and acknowledged for over 1.5 million children in fiscal year 1999. There were 811,201 IV-D, and 734,957 statewide paternities established and acknowledged for fiscal year 1999. (Table 2)

Orders Established. States must use standard guidelines to determine how much a parent should pay for child support. CSE staff can take child support cases to court, or to an administrative hearing process to establish the order. Almost 1.2 million orders for child support were established in fiscal year 1999. Never assistance orders made up 40 percent of the support orders established for fiscal year 1999, current assistance orders accounted for 26 percent, and former assistance 33 percent. (Table 2)

Collections. Total child support collections were $15.8 billion for fiscal year 1999 (Table 1 and 3). This was a 10 percent increase in collections over fiscal year 1998. Collection data are shown under the new reporting categories: current IV-A and IV-E assistance ($1.5 billion), former assistance ($4.8 billion), and never assistance ($9.5 billion) instead of the former TANF/FC and Non-TANF.

Collections per Full-Time Equivalent Staff. The amount of child support collected nationally per full-time equivalent staff (FTE) was $277,818 in fiscal year 1999 (Table 8). There were 57,028 FTE staff reported in fiscal year 1999.

Expenditures. In fiscal year 1999, total administrative expenditures were $4.0 billion, a 13 percent increase from fiscal year 1998. The federal share of expenditures was almost $2.7 billion and the state share was almost $1.4 billion for fiscal year 1999. Estimated Incentives Payments for fiscal year 1999 was nearly 400 million (Table 5). It should be noted that the new incentives established by The Performance and Incentive Act of 1998 do not go into effect until FY 2000.

Collections Due and Distributed. The total amount of current support due for fiscal year 1999 was $21 billion (Table 9), about $11 billion or 52 percent of that amount was distributed (Table 10). Total amount of support collected and distributed as arrears was $5 billion or 6.9 percent (Table 12). The total number of cases with arrears due was 8.8 million and almost 4.8 million, of these cases had collections (Table 13). This means 54 percent of these cases had some payment toward their arrears in fiscal year 1999. Interstate collections forwarded to other States was almost $1.1 billion in FY 99 (Table 14).

Other Statistics. Program increases were also noted in FY 99 for total cases in which a collection was made, 6.1 million. The total number of children in IV-D cases in fiscal year 1999 was 19,759,700 (Figure 9). This is an average of less than 2 children (1.2) per child support case. The cost effectiveness ratio of $3.92 is shown on Table 1.
