The
Child Support Enforcement (CSE) program is a joint Federal, State,
and local partnership established to ensure that parents provide
support to their children. Through this program, non-custodial
parents are located, paternity is established, support orders are
issued and enforced, and collections are received and
distributed.
The
program includes 54 separate State and Territory child support
systems, each with its own unique laws and procedures. The program
is usually run by state and local human service agencies, often
with the help of prosecuting attorneys and other law enforcement
officials, as well as officials, of family or domestic relations
courts.
Child
support enforcement services are available automatically for
families receiving assistance under the Temporary Assistance for
Needy Families (TANF) program. Child support collected reimburses
the State and Federal governments for TANF payments made to the
family. Child support collections above the TANF grant amount go
directly to the family, as well as, some passthrough and disregard
payments which are voluntarily made by some states. Child support
services are available to families not receiving TANF who apply for
such services, as well as, families who were formerly on TANF.
Child support payments collected on behalf of non-TANF families are
sent to the family.
1.2. Program Results for FY 2000
The
following data tables provide information on the Child Support
Enforcement (CSE) program for fiscal year 2000, and in some cases
for the last five years. Table 1 provides national totals on child
support collections, expenditures, and cost-effectiveness for
fiscal year 2000. Table 2 gives national statistics on the CSE
caseload, cases with collections, percentage of cases with
collections, cases with orders established, percentage of cases
with orders established, percentage of cases with collections to
cases with orders established, paternities established or
acknowledged, and child support orders established, for the same
time period. Table 3 provides child support trends over several
years. Tables 4 through 6 provide individual state financial
information; while tables 7 and 8 provide statistical information
for each state. Table 9 provides collections per full-time
equivalent (FTE) information. Tables 10 through 17 provide much of
the data to be used to calculate state performance measures. Table
18 lists interstate collections for each state.
Some
of these data form the basis for incentives paid to states as a
result of the Child Support Performance and Incentive Act of 1998
(CSPIA). No assumption regarding individual state data reliability
is made. Readers should note that all numbers quoted are based on
information supplied to the Office of Child Support Enforcement
(OCSE) by the individual state CSE programs.
During FY 2000, about $17.9 billion
in child support payments were collected. Total caseload was almost
17.4 million. The CSE program had almost 1.6 million paternities
established or acknowledged and almost 1.2 million new child
support orders were established in 2000.
Caseload. OCSE defines a
child support case as a parent (mother, father, or putative father)
who is now or eventually may be obligated under law for the support
of a child or children receiving services under the title IV-D
program.
A
current assistance case is a case where the children are:
(1) recipients of Temporary Assistance for Needy Families (TANF)
under title IV-A of the Social Security Act or (2) entitled to
Foster Care maintenance payments under title IV-E of the Social
Security Act. In addition, the children’s support rights have
been assigned by a caretaker relative to the state and a referral
to the state IV-D agency has been made. A former assistance
case is a case where the children were formerly receiving title
IV-A (AFDC or TANF) or title IV-E Foster Care services. A
never assistance case is a case where the children are
receiving services under the title IV-D program, but are not
currently eligible for and have not previously received assistance
under titles IV-A or IV-E of the Social Security Act. This
includes cases where the family is receiving IV-D services as a
result of a written application for IV-D services, including cases
where children are receiving state (not title IV-E) foster care
services or a case where they are Medicaid recipients not
receiving additional assistance.
There
were about 17.4 million cases reported in the child support
enforcement program during fiscal year 2000. There was less than a
one percent increase in caseload since fiscal year 1999. There were
almost 3.3 million current assistance cases, 8.0 million former
assistance cases, and 6.2 million never assistance cases reported
in fiscal year 2000 (Table 2).
Paternities Established. When children are born out-of-wedlock
establishing paternity is a first step for obtaining a child
support order. Paternity establishment involves the legal
establishment of fatherhood for a child. Paternity can be
established by a voluntary acknowledgement signed by both parents
either as part of an in-hospital or other acknowledgement program.
States must have procedures that allow paternity to be established
at least up to the child’s eighteenth birthday.
Child
support paternities were established or acknowledged for about 1.6
million children in fiscal year 2000, almost a 3 percent decrease
from levels states reported in fiscal year 1999. There were 867,071
IV-D paternities and 688,510 in-hospital and other paternities
acknowledged for fiscal year 2000. (Table 2)
Orders Established. States
must use standard guidelines to determine how much a parent should
pay for child support. CSE staff can take child support cases to
court, or to an administrative hearing process to establish the
order.
Almost 1.2 million orders for child
support were established in fiscal year 2000. Never
assistance orders made up 40 percent of the support orders
established for fiscal year 2000, current assistance orders
accounted for 22 percent, and former assistance 37 percent.

Collections. Total child
support collections were $17.9 billion for fiscal year 2000 (Tables
1 and 3). This was a 12 percent increase in collections over the
$15.9 collected during fiscal year 1999. Collection data are shown
under the new reporting categories: current IV-A and IV-E
assistance ($1.4 billion), former assistance ($6.8
billion), and never assistance ($9.7 billion) in table 1,
and under TANF and Non-TANF categories in table 3 to allow
comparisons with previous years.
Collections per Full-Time
Equivalent Staff. The amount of child support collected
nationally per full-time equivalent staff (FTE) was $306,927 in
fiscal year 2000 (Table 9). There were 58,171 FTE staff reported in
fiscal year 2000.
Expenditures. In fiscal year
2000, total administrative expenditures were $4.5 billion, a 12
percent increase from fiscal year 1999. The federal share of
expenditures was almost $3.0 billion and the state share was over
$1.5 billion for fiscal year 2000. Estimated incentives payments
for fiscal year 2000 were nearly $353 million (Table 6). Actual
incentives earned for fiscal year 2000 cannot be determined until
data reliability audits are complete for every state. Once these
audits are completed, final incentive levels can be determined, and
estimated and actual incentives can be reconciled.
It
should be noted that the new incentives established by the Child
Support Performance and Incentive Act of 1998 went into effect in
fiscal year 2000 and impacted one-third of a state’s
incentives for that year.
Collections Due and
Distributed. The total amount of current support due for fiscal
year 2000 was $23 billion (Table 10), almost $13 billion, or 56
percent, of that amount was collected and distributed (Table 11).
The total amount of support of arrearages due in fiscal year 2000
for all previous fiscal years was $84 billion (Table 12), almost $6
billion was collected and distributed (Table 13). There were almost
10 million cases with arrears due in fiscal year 2000 and almost
5.6 million of these cases had collections (Table 14). Hence, 57
percent of arrears cases had some payment toward their arrears in
fiscal year 2000. There were $1.2 billion in interstate collections
forwarded to other states in fiscal year 2000 (Table
18).
Other Statistics. In fiscal
year 2000, program increases were noted for total cases in which
a collection was made. At 7.2 million, this is a 10 percent
increase over the number of paying cases for fiscal year
1999.
There
were almost 10.7 million cases with an order in fiscal year
2000. This a 4 percent increase over the number of cases with
orders reported in the previous fiscal year.
The
total number of children in CSE cases totaled more than 19
million in fiscal year 2000. While this represents a slight
decrease under the number reported for fiscal year 1999--this
change is more likely due to improved accuracy in reporting, than
any significant change in the number of children in the child
support caseload
The
traditional cost effectiveness ratio for fiscal year 2000
was $3.95. Cost-effectiveness represents the amount of child
support collected for every $1.00 expended on the program. With the
effective date of the Child Support Performance and Incentive Act
of 1998 (CSPIA), states are evaluated under a new
cost-effectiveness number that will be phased-in over three years.
The CSPIA cost-effectiveness ratio was $4.21 for fiscal year
2000 (Table 16).
