TO:STATE AGENCIES ADMINISTERING CHILD SUPPORT Enforcement PLANS UNDER TITLE IV-D OF THE SOCIAL SECURITY ACT, AND OTHER INTERESTED INDIVIDUALS

SUBJECT: FPLS TRANSMITTAL CERTIFICATION

CONTENT:The Federal Parent Locator Service provides to State IV-D Agencies, address information obtained from various Federal agencies. The information obtained from the Internal Revenue Service and the Social Security Administration is considered tax information. lt is imperative that all State and local jurisdictions who use this data be aware of the need to safeguard confidential Federal tax data and be advised that failure to comply with safeguard regulations and procedures could result in specific penalties. The specific penalties for unauthorized disclosure include civil penalties (26 USC 7217) and criminal penalties (26 USC 7213 (a) (2)).

For this reason OCSE has amended the required letter of certification to include a reference to the specific statutory penalties for unauthorized disclosure of Federal tax information.

ACTION: All future magnetic tape, punchcard or pre-printed form requests for FPLS information must be accompanied by the revised version of the Transmittal Certification letter. States and local jurisdictions submitting requests via remote terminals will be required to use the revised letter at the time of their periodic certification renewal. (An update to the Federal PLS State User Guide has been issued).

SUBJECT:Requests to Federal Parent Locator Service for Information on Absent Parents

I certify that every request included with this transmittal (or input via the interactive terminal) meets the following requirements:

(1)lt is being made to locate an absent parent for the purpose of establishing paternity or securing child support, and for no other purpose.

(2)Our agency has made diligent and reasonable efforts to locate the absent parent. (See 45 CFR 302.3,5).

(3)Our agency has in effect protective measures to safeguard the personal information being submitted to and received from the Federal Parent Locator Service.

(4)Information received from the Federal Parent Locator Service will be treated as confidential and its use or disclosure will be limited to the purposes prescribed by 45 CFR 302.18.

(5)Our agency is aware that unauthorized use or disclosure of Federal tax information obtained through the Federal Parent locator Service could result in civil penalties (26 USC 7217) and criminal penalties (26 USC 7213(a)(2).
