Kentucky Transitional Assistance Program (K-TAP)

2. Description of the Major Program Benefits, Services, and Activities:

K-TAP is the TANF cash assistance program in Kentucky. Kentucky Works is the name of the work activities program for the K-TAP program. A description of the major program benefits, services and activities are included in the FY 2003-2004 TANF State Plan, the "Kentucky Transitional Assistance Program (K-TAP) Cash Assistance" section, pages 3-9; and "Kentucky Works Program" section, pages 10-22. MOE is only used for benefits and activities previously authorized under former Titles IV-A and IV-F.

Cash assistance, work activities program, and supportive services.

The TANF program in Kentucky as required by 45 C.F.R 265.9(b) for FY 2004:

(1) The State's definition of each work activity;

• Kentucky's definitions for work activities are listed in the TANF State Plan, "Kentucky Works" section, "Components" subsection, pages 12-15.

(2) A description of the transitional services provided to families no longer receiving assistance due to employment;

• Transitional services that are provided to families who are no longer receiving assistance due to employment are listed in the TANF State Plan, "Transitional Services for Families No longer Receiving Cash Assistance" section, pages 27 to 28. The TANF State Plan was amended in January 2004 to complete the phase-out of Job Retention bonuses.

(3) A description of how a State will reduce the amount of assistance payable to a family when an individual refuses to engage in work without good cause pursuant to Sec. 261.14 of this chapter;

• The penalties to a family when an individual refuses to participate in work activities without good cause are described in the TANF State Plan, "Kentucky Works Penalties" section, pages 16 to 18, and in the "Work After 24 Months" section, page 19.

(5) If the State has adopted the Family Violence Option and wants
Federal recognition of its good cause domestic violence waivers under
45 CFR 260.50-58, the provide (a) a description of the strategies
and procedures in place to ensure that victims of domestic violence
receive appropriate alternative services and (b) an aggregate figure for
the total number of good cause domestic waivers granted;

(a) The descriptions of the strategies and procedures in place to ensure that victims of domestic violence receive appropriate alternative services are found in the TANF State Plan, “Victims of Domestic Violence” subsection, page 9, “Participation” subsection, page 10, and “Components” subsection, page 14.
(b) The average monthly number of individuals for FY 2004 was 40.

(6) A description of any nonrecurrent, short-term benefits provided, including:
(i) The eligibility criteria associated with such benefits, including any restrictions on the amount, duration, or frequency of payments;
(ii) Any policies that limit such payments to families that are eligible for TANF assistance or that have the effect of delaying or suspending a family's eligibility for assistance; and
(iii) Any procedures or activities developed under the TANF program to ensure that individuals diverted from assistance receive information about, referrals to, or access to other program benefits (such as Medicaid and food
stamps) that might help them make the transition from welfare to work.

• The information listed above is provided in the TANF State Plan, "Diversion Program" section, pages 26 to 27, regarding the Family Alternatives Diversion (FAD) program. FAD is funded with TANF funds.

(7) A description of the procedures the State has established and is maintaining to resolve displacement complaints, pursuant to section 407(f)(3) of the Social Security Act. This description must include the name of the State agency with the lead responsibility for administering this provision and explanations of how the State has notified the public about these procedures and how an individual can register a complaint.

• A description of the procedures established and maintained to resolve displacement complaints is provided in the TANF State Plan, "Resolution of Displacement Complaints" section, page 15. The agency or office sponsoring the work activity signs an agreement with the Kentucky Cabinet for Families and Children and a contract with the Kentucky Education Cabinet, Office of Employment and Training, to ensure the work activity does not:
– Result in the displacement of any currently employed worker or position, including partial displacement, such as a reduction in hours of non-overtime work, wages or employment benefits;
– Result in the filling of a position:
· When any other person is on layoff from the same or equivalent job within that organization;
· When an employer terminated any regular employee or reduced its workforce with the effect of filling the vacancy created;

• Infringe in any way upon promotional opportunities of any currently employed individual; and

• Result in the filling of any established unfilled position vacancy by a participant.

• Grievances and/or complaints are forwarded to the Department for Community Based Services, Kentucky Cabinet for Health and Family Services, for resolution through the conciliation and/or administrative hearing process. A description of these processes may be found in the TANF State Plan in the Kentucky Works Section, Conciliation subsection, page 16 and the Miscellaneous section, Hearing Rights subsection, page 31.

(8) A summary of State programs and activities directed at the
third and fourth statutory purposes of TANF (as specified at
Sec. 260.20(c) and (d) of this chapter); and

• A description of services to prevent and reduce the incidence of out-of-wedlock pregnancies is included in the TANF State Plan, "Miscellaneous" section; "Activities to Reduce Teen Pregnancy" subsection, pages 31 to 32; "Family Planning Services" subsection, page 32; and "HANDS (Health Access; Nurturing Development Services)" subsection, page 32-33.

• A description of services to encourage the formation and maintenance of two (2) parent families is included in the TANF State Plan, "Family Services" section, pages 22 to 23.

(9) An estimate of the total number of individuals who have
participated in subsidized employment under Sec. 261.30(b) or (c) of
this chapter.

• The average monthly number of individuals who have participated in subsidized employment for FY 2004 was 39.
