Annual Report on State TANF and MOE Programs - 2005
Delaware

This Annual Report is submitted pursuant to requirements in 45CFR Section 265.9. Information required to be reported that is included in the State of Delaware State Plan for Delaware’s TEMPORARY ASSISTANCE FOR NEEDY FAMILIES Welfare Reform Program is referenced accordingly.

Section 265.9(b)(1): The State’s Definition of Each Work Activity. Reference State Plan, page 21, “Services to Move Families to Work” for allowable work activities. Definitions are as follows:

Work Readiness/Life Skills - helping participants obtain the life skills necessary to prepare for the world of work, e.g., time management skills, socialization skills, stress management skills.

Job Search/Job Placement - assisting participants in their efforts to seek employment that is appropriate with their education, skills, and abilities.

Job Retention - helping participants in their efforts to keep and maintain employment.

Work Experience/OJT - placement of participants in either paid or unpaid positions for the expressed purpose of providing them with an experience of work or providing them specific training to learn a specific job skill.

Vocational Skills Training - job skills training for specific job positions, e.g., computer operator, carpenter, etc.

Retention Basic Skills Training - training participants in the skills necessary to keep and maintain employment.

Education - as described in SB101 (State Plan “Attachment D”), effective 7/2/99. This bill allows participants to participate in secondary, post-secondary or vocational education. Secondary education would include high school, GED, and Adult Basic Education. Post-secondary would include an approved program or education leading to either an associate’s degree or a baccalaureate degree. It would not include a graduate degree program or a “second” four year degree program. Vocational education would be education for a specific job skill, e.g., nursing, child care worker, etc.

Section 265.9(b)(2): A description of the transitional services provided to families no longer receiving assistance is listed in Delaware’s TANF State Plan on pages 24-25, under “Supportive Services.”

Section 265.9(b)(3): The description of how Delaware will reduce the amount of assistance payable to a family when an individual refuses to engage in work without good cause pursuant to Section 261.14 is found in Delaware’s TANF State Plan on pages 30-31, under “Sanctions: Failure to comply with the Contract and the Imposition of Sanctions.”

Section 265.9(b)(4): The average monthly number of payments for child care services made by the State through the use of disregards by the following types of child care providers:
(i) Licensed/regulated in-home child care;

(ii) Licensed/regulated family child care;

(iii) Licensed/regulated group home child care;

(iv) Licensed/regulated center-based child care;

(v) Legally operating (i.e., no license category available in State or locality)
in-home child care provided by a non-relative;

(vi) Legally operating (i.e., no license category available in State or locality)
in-home child care provided by a relative;

(vii) Legally operating (i.e., no license category available in State or locality)
family care provided by a non-relative.

(viii) Legally operating (i.e., no license category available in State or locality)
family child care provided by a relative;

(ix) Legally operating (i.e., no license category available in State or locality)
group child care provided by a non-relative;

Delaware funds child care provided through disregards with State only funds.

Section 265.9(b)(5): Delaware has adopted the Family Violence Option. A description of the strategies and procedures in place to ensure victims of domestic violence receive appropriate alternative services is found in Delaware’s TANF State Plan on pages 36-37 under “Addressing Problems of Statutory Rape and Domestic Violence,” Attachment F in the TANF State Plan “Protection from Abuse Act,” and Attachment H in the TANF State Plan “Questions To Screen For Domestic Violence.”

Section 265.9(b)(6): A description of any nonrecurrent, short-term benefits provided, including:

(i) The eligibility criteria associated with such benefits, including any restrictions on the amount, duration, or frequency of payments;

(ii) Any policies that limit such payments to families that are eligible for TANF assistance or that have the effect of delaying or suspending a family’s eligibility for assistance; and

(iii) Any procedures or activities developed under the TANF program to ensure that individuals diverted from assistance receive information about, referrals to, or access to other program benefits (such as Medicaid and food stamps) that might help them make the transition from welfare to work.

Delaware’s Diversion Assistance Program is described in the TANF State Plan on pages 11-12. Delaware’s Emergency Assistance Program is described in Attachment B of the TANF State Plan. Delaware continues to operate Emergency Assistance using the eligibility criteria, scope, and duration as described in the 8/21/1996 AFDC State Plan.

265.9(b)(7): Delaware has established and is maintaining procedures to resolve displacement complaints pursuant to Section 407(f)(3) of the Act. The procedures are described on page 24 of the TANF State Plan under “Protecting Current Workers From Displacement.”

265.9(b)(8): State programs and activities directed at the third and fourth statutory purpose of TANF (as specified at Section 260.20(c) and (d) of the chapter) is summarized on pages 33-35 under, “Efforts to Reduce Out-Of-Wedlock Births,” and on page 36 under, “Initiatives to Promote Two-Parent Families.” A summary of State programs and activities directed at the third and fourth statutory purposes of TANF (as specified at Section 260.20(c) and (d) of this chapter. Reference State Plan, pages 33-35, “Efforts to Reduce Out-of-Wedlock Births”, and page 36, “Initiatives to Promote Two-Parent Families.”

265.9(b)(9): An estimate of the total number of individuals who have participated in subsidized employment under Section 261.30(b) or (c) of this chapter. Delaware has established a subsidized work program. At this time, there are no participants in the program.

265.9(c): Each State must provide the following information on the State’s program(s) for which the State claims MOE expenditures:

(1) The name of each program and a description of the major activities provided to eligible families under each such program;

(2) Each program’s statement of purpose;

(3) If applicable, a description of the work activities in each separate State MOE program in which eligible families are participating;

(4) For each program, both the total annual State expenditures and the total annual State expenditures claimed as MOE;

(5) For each program, the average monthly total number or the total number of eligible families served for which the State claims MOE expenditures as of the end of the fiscal year;

(6) The eligibility criteria for the families served under each program/activity;

(7) A statement whether the program/activity had been previously authorized and allowable as of August 21, 1996, under section 403 of prior law;

(8) The FY 1995 State expenditures for each program/activity not authorized and allowable as of August 21, 1996, under section 403 of prior law;

(9) A certification that those families for which the State is claiming MOE expenditures met the State’s criteria for “eligible families.”

1. Program Name: Two-Parent TANF Program

2. Description of Major Program Activities: Delaware’s Two-Parent TANF Welfare Reform Program has been operated as a separate state program since FY 1999. Delaware eliminated special eligibility conditions for two-parent families as part of its 1995 TANF waiver demonstration. Thus, eligibility factors for one and two-parent families are identical.

3. Program Purpose: To promote two-parent families; to provide broad-based support for working families.

Description of Work Activities (Complete only if a separate State/local program): Two-parent families who are not working in unsubsidized employment only receive benefits through participation in a Work for Your Welfare component. To receive TANF, one parent must participate in Work for Your Welfare and the second parent must participate in an employment related activity. The number of hours of work is determined by dividing the TANF and Food Stamps benefits by the minimum wage. In addition to work experience, participants are expected to conduct up to 10 hours each week of job search.

9. Eligibility Criteria for Families Served: A family’s income must be less than the gross and net income limits to be financially eligible for TANF. For the gross income test, the family’s income is compared to 185% of Delaware’s standard of need. Gross income is the total of the earned and unearned income. They must also meet a net income test. For applicants, the net income is compared to Delaware’s payment standard. For recipients, the net income is compared to the standard of need.

If the income tests are met, a two-parent family that meets work requirements will be eligible to receive TANF if there is an eligible child living in the home, and citizenship, and other statutory requirements are met.

1. Program Name: Department of Labor - Contracted Services, Single-Parent Families

2. Description of Major Program Activities: Delaware has contracted with private for-profit and non-profit providers and the local community college network to provide job readiness, job placement and retention services to TANF clients. For example, TANF provides Get-a-Job, Hard-to-Place, and Remediation services using such contracts. All contracts are performance-based, paying providers based on results achieved. Contracted employment services now also include supportive services such as eye examinations and corrective lenses, dental and physicals not covered by Medicaid, transportation fees, training, work-related equipment, uniforms, shoes and supplies. These supportive services are provided by vouchers. On a case-by-case basis certificates, licenses, or testing fees may also be provided if it is to obtain employment. Delaware uses MOE funds to provide these services.

2. Description of Major Program Activities: Delaware uses MOE funds to provide child care to non-working TANF recipients participating in TANF approved work preparation activities, and co-pay child care to working recipients and low-earning Delaware families.

3. Program Purpose: To enable families to pay for child care while engaged in work preparation and/or employment; to enable low-earning families to pay child care expenses so they can accept and retain employment.

1. Program Name: Substance Abuse, Counseling and Treatment: (Bridge) Single-Parent and Child-Only Families

2. Description of Major Program Activities: The Bridge Program makes assessments to determine if a client has substance abuse problems. If the assessment indicates a substance abuse problem, they refer clients for treatment. The Bridge agencies track clients to ensure compliance with recommended treatment and alert TANF staff if a sanction should be imposed. TANF staff use C.A.G.E. questions to determine if a referral to the Bridge Program is necessary.

3. Program Purpose: To provide quick and appropriate assessment and treatment services so that substance abuser can enter the unsubsidized job market.

2. Description of Major Program Activities: Approved cost-allocation plan which differentiates between client time and administration time. Within client time, activities are differentiated between benefit determination and calculation activities from employment related activities and Contract of Mutual Responsibility activities. This reports specifically DSS staff time as it relates to employment related responsibilities and Contract of Mutual Responsibility activities.

2. Description of Major Program Activities: Delaware uses MOE funds to provide child care to working low earning Delaware families. These state dollars are used for both TANF MOE and Child Care Development Fund MOE.
