In accordance with the Paperwork Reduction Act of 1995, collection of this information has been approved by the Office of Management and Budget (OMB) under OMB Control Number 0970-0290, expiration date 10-31-2008.  Submission of this information, however, is voluntary.  The public reporting burden for this collection of information is estimated to average 24 hours per response, including the time for reviewing instructions, gathering and maintaining the data needed, and reviewing the collection of information.  An agency may not conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number.

As a point of reference, under the Improper Payments Information Act of 2002, the term, “Improper Payment”

(a)  means any payment that should not have been made or that was made in an incorrect amount (including overpayments and underpayments) under statutory, contractual, administrative, or other legally applicable requirements; and

(b)  includes any payment to an ineligible recipient, any payment for an ineligible service, any duplicate payment, payments for services not received, and any payment that does not account for applicable discounts.

1.       How does the TANF Lead Agency define improper payments?

An improper payment is either an overpayment or underpayment of cash assistance.  An overpayment is a Cash Assistance payment made in excess of the amount a recipient is entitled to receive.  An underpayment is a Cash Assistance payment of less than the amount a recipient is entitled to receive.

Delaware’s Audit Recovery and Management Services unit is responsible for the identification of acts of welfare fraud/overpayments from information obtained through IEVS, agency referrals, citizen complaints and other sources.  Improper payments are also identified by the supervisor or Quality Control during a case review.  They are also reported by clients who call with a question about their benefit.

Prevention of Improper Payments

11.   Please describe your top 3 priorities for preventing and reducing improper payments (e.g., training/meetings for providers on rules and responsibilities; training for agency staff on correct implementation of rules and responsibilities; clear communication with parents on rules and responsibilities; use of information technology.)

Training for staff on correct implementation of rules and responsibilities is a top priority.  Staff are trained by our training department when hired and also provided with refresher training periodically.  On the job training is also an important component.  Meetings and trainings for providers is also a priority.  Meetings are held monthly with representatives from our employment and training contractors, eligibility staff and systems staff.  Trainings are provided to contractors upon request.  The interview process emphasis the rules and responsibilities for parents.  A Contract of Mutual responsibility is developed with the parent and signed.  This contract is monitored by the eligibility worker for compliance.  Our computer system is programmed with the program eligibility rules and includes hard and soft edits to reduce the chance of error.  Reports are available monthly to identify error prone cases.
