SUBJECT: National Waiver of the 60-Month Limitation on Social Services

Pursuant to my authority as Director of the Office of Refugee Resettlement (ORR) under 45 CFR 400.300, I am waiving the 60-month limitation at 45 CFR 400.152(b) on provision of social services to refugees who have been in the United States for more than 60 months. My decision to waive this provision on a national basis is for the purpose of providing critical social services to victims of Hurricane Katrina who are in desperate need of these services. This waiver is appropriate and consistent with refugee policy objectives.

This waiver will be in effect from September 1, 2005 through September 30, 2006 for all States and Wilson/Fish grantees participating in the refugee resettlement program. This waiver applies to persons who are refugees, asylees, Amerasian immigrants from Viet Nam, entrants, and victims of a severe form of trafficking who have received certification or eligibility letters from ORR, and certain family members of trafficking victims eligible since December 2003.
