SUBJECT: National Waiver of the 60-Month Limitation on Targeted Assistance for Refugees Evacuated or Displaced by Hurricane Katrina

Pursuant to my authority as Director of the Office of Refugee Resettlement (ORR) under 45 CFR 400.300, I am waiving the 60-month limitation on targeted assistance set forth at 45 CFR 400.315(b). This waiver shall be limited to ORR populations, who have been evacuated or displaced as a result of the tragic events surrounding Hurricane Katrina and have been in the United States for more than 60 months. Please be advised that refugees who have naturalized (are citizens) are not eligible for ORR-funded services. My decision to waive this provision for this population, is for the purpose of providing targeted assistance to victims of Hurricane Katrina who are in desperate need of these services. This waiver is appropriate and consistent with refugee policy objectives.

This waiver will be in effect from September 1, 2005 through September 30, 2006 for all States and Wilson/Fish grantees participating in the targeted assistance refugee resettlement program. This waiver applies to persons who are refugees, asylees, Amerasian immigrants from Viet Nam, Cuban/Haitian entrants, and victims of a severe form of trafficking who have received certification or eligibility letters from ORR, and certain family members of trafficking victims eligible since December 2003.
