DEAR COLLEAGUE LETTER

DCL-01-05

RE: Internal Revenue Service (IRS) Notice

This is an update to the information provided in DCL-01-03 dated January 16, 2001, regarding the "Internal Revenue Service (IRS) Use of Federal Case Registry (FCR) Information", and the letter which IRS recently sent to taxpayers which created a deluge of inquiries to Child Support offices.

The Federal Office of Child Support Enforcement (OCSE), several State IV-D Directors and the IRS, working together, have effected the following resolution. IRS is sending another letter to the taxpayers that received the first notice. A prototype of that letter is attached and the same letter on IRS letterhead is being faxed to you today. This notice informs the taxpayer that the first notice contained incorrect information about child support agency records and custody information, and instructs the taxpayers not to call the Child Support Offices. IRS will also provide this notice to their call center operations (1-800-829-1040) and instruct their staff to inform callers not to call the Child Support offices regarding this notice.

In addition to the information above, OCSE is scheduling a conference call for States on Monday, January 22, 2001, 4:00 p.m., EST for any further updates. The toll free number to call is 1-800-857-5735, and it will be available 20 minutes prior to the start time. The passcode is 18437 and the leader's name is Scott Hale. The passcode and the leader name are required to access the call.

We regret the disruption this has caused to the Child Support agencies and the taxpayers who received the prior notice.

Sincerely,

Frank Fuentes
Deputy Commissioner and Acting Operating Head
Office of Child Support Enforcement
