SUBJECT: States Harmless from Penalties for Failure to Comply with PIQ-18-02
Due to the recently published Notice of Proposed Rulemaking on December 18, 2018, in the Federal Register, on page 64803, Volume 83, Number 242, the federal Office of Child Support Enforcement (OCSE) is reviewing comments on the proposed changes to withholding of Supplemental Security Income (SSI), Social Security Disability Insurance (SSDI), and Social Security Retirement (SSR) concurrent benefits.
While OCSE conducts this review, state child support agencies will not be penalized if OCSE is unable to certify that the state child support agency is in compliance with Questions 2 and 3 in OCSE-PIQ-18-02. All federal reporting requirements remain in effect, although any review of state compliance with the above withholding guidance is temporarily suspended.
