Refugee Children of Non-Biological Family Units

State Letter #10-06
April 29, 2010

ORR asks those assisting families to pay particular attention to the special needs of non‑biological, refugee family units when they arrive in the US.

Reviews the definition of “Cuban and Haitian entrant” as it applies to Haitian nationals and clarifies the necessary documentation for ORR-funded benefits and services.

Afghan and Iraqi Special Immigrants are now eligible for ORR benefits and services for the same time period as refugees.

ORR advises refugees of the legal requirement to do three things: 1) apply to USCIS to adjust their status to Lawful Permanent Resident (LPR) after one year in the U.S. in refugee status, 2) advise USCIS prior to travel outside the U.S. so they can be issued the Refugee Travel Document, and 3) report their change of address to USCIS.

Clarifies that Afghan Special Immigrants are eligible for ORR benefits and services beyond September 30, 2008.

Stipulates that Iraqi/Afghan Special Immigrants are eligible for ORR benefits/services but are limited to 6 months from date of admission to U.S.

Stipulates that non-Cuban spouses and children are not eligible for ORR benefits and services unless they have another status qualifying them for ORR assistance.

Clarifies the meaning of employment to assist Refugee Service Providers to correctly report successful refugee employment outcomes.
