SUBJECT: NPRM - Paternity Establishment Percentage Performance Relief

Due to the impact of the COVID-19 public health emergency on state child support program operations, this Notice of Proposed Rulemaking (NPRM) would provide relief from Paternity Establishment Percentage (PEP) performance penalties by:
- Modifying the PEP performance threshold from 90% to 50% for federal fiscal years 2020 and 2021, and
- Providing that adverse findings of data reliability audits of a state’s paternity establishment data will not result in a penalty.
COMMENTS: OCSE will consider comments received by Nov. 18, 2021. Submissions must include the agency name and reference RIN 0970-AC86. All comments received will be posted without change to Regulations.gov , including any personal information provided.
