SUBJECT: NPRM Withdrawal - Optional Exceptions to Child Support Guidelines

OCSE is withdrawing the notice of proposed rulemaking (NPRM) published Sept. 17, 2020, which solicited public comment on two optional exceptions to the prohibition against treating incarceration as voluntary unemployment in child support cases.

The existing prohibition remains in effect, as set out in the Flexibility, Efficiency, and Modernization in Child Support Programs (FEM) rule and 45 CFR 302.56(c)(3).
