SUBJECT: Submit Revised State IV-D Plan Page 3.8-3 to Comply with Technical Corrections Final Rule

The Technical Corrections Final Rule  (PDF) was published on June 9, 2020. The Final Rule amended 45 CFR 307.11(c)(3) to provide policy clarification. Subsequently, state plan preprint page 3.8-3 was revised to address the following amendments to the child support regulations:

• Added Social Security Retirement (SSR) benefits when referring to concurrent Supplemental Security Income (SSI) and Social Security Disability Insurance (SSDI) under title II, in accordance with 45 CFR 307.11(c)(3).
• In accordance with 45 CFR 307.11(c)(3)(iii), added an optional component for states regarding noncustodial parents who receive concurrent SSI payments and either SSDI or SSR benefits under title II of the Act. For those noncustodial parents who are beneficiaries of SSI and concurrent SSDI or SSR, the state has the option to prevent garnishment of the concurrent SSI and SSDI or SSR payment through an income withholding order, and return funds incorrectly withheld in accordance with 45 CFR 303.100(a)(8) when deemed appropriate by the state.

ACTION REQUIRED: Submit the state plan preprint page along with a completed transmittal notice form (OCSE-21-U4) via the online state plan system in accordance with AT-15-02, attesting to compliance with the requirements set forth on this page by February 4, 2021.
