SUBJECT: NPRM - Optional Exceptions to the Child Support Guidelines

This Notice of Proposed Rulemaking (NPRM) proposes to provide states with the flexibility to incorporate in their child support guidelines two optional exceptions to the prohibition against treating incarceration as voluntary unemployment. The proposed exceptions are:

  1. When the individual is incarcerated due to intentional nonpayment of child support and/or
  2. For any offense of which the individual’s dependent child or the child support recipient was a victim.

The state may apply the exception to the individual’s other child support cases.

COMMENTS: OCSE will consider comments received by November 16, 2020. Submissions must include the agency name and docket number or RIN (0970-AC81) for this rulemaking. All comments received will be posted without change to https://www.regulations.gov , including any personal information provided.
