TO: STATE AGENCIES ADMINISTERING CHILD SUPPORT ENFORCEMENT PLANS UNDER TITLE IV-D OF THE SOCIAL SECURITY ACT AND OTHER INTERESTED INDIVIDUALS
SUBJECT: Revision to the Title IV-D State Plan Preprint and Submission of State Plan Page to Indicate Compliance with Federal Requirements for submitting an advance planning document (APD) or APD update.
ATTACHMENT: Attached is a new and revised State plan preprint page 3.8-1 which reflects changes made to the State plan provisions of title IV-D of the Social Security Act (the Act) by P.L. 100-485, the Family Support Act of 1988.
The attachment consists of:
Section 3.8, Computerized Support Enforcement System. This section has been amended by replacing the plan page with a new page 3.8-1. This page certifies State compliance with the requirement that the State submit an advance planning document (APD) or APD update
The Family Support Act (P.L. 100-485, section 123) requires that any State that did not have in effect on October 13, 1988 an automated data processing and information retrieval system meeting all title IV-D program requirements must submit by October 1, 1991 an advance automated data processing planning document for review and approval by the Secretary. Procedures and guidance for submitting APDs are outlined in program instructions issued October 1, 1990(OCSE-AT-90-10). States without an approved APD for a statewide, comprehensive system must submit an APD to install a new system or modify an existing system which will meet the requirements of section 454(16) as implemented in 45 CFR Part 307, or submit an APD containing a waiver request in accordance with the waiver provisions of the Act. States with an approved implementation APD must submit an APD update not later than October 1, 1991 to automate the requirements of the Family Support Act of 1988. States with a certified system that does not include the requirements of the Family Support Act must submit an APD or APD update, not later than October 1, 1991to automate the provisions of the Family Support Act of 1988. Any State which fails to submit an approvable APD by October 1, 1991 will be subject to the State IV-D plan disapproval process which could result in a loss of all IV-D funding. Proposed regulations on Computerized Support Systems were issued May 14, 1991. Although final regulations have not been published, States must submit page 3.8-1, Computerized Support Enforcement System, for final approval. Regional Administrators will determine whether to grant final approval or recommend disapproval of the State Plan amendments.
APPROVAL OF STATE PLAN
States must submit page 3.8-1, Computerized Support Enforcement System, along with a completed transmittal notice form (OCSE-21-U4) to the appropriate ACF Regional Administrator no later than December 31, 1991 attesting to compliance with this requirement of the Family Support Act of 1988.
ACTION REQUIRED: Submit page 3.8-1 no later than December 31, 1991.
