Legislative Authority

On January 4, 1975, a new Title XX was added to the Social Security Act, which authorized an entitlement to States for the provision of social services. Prior to Title XX, States received matching Federal funds for specified categories of services, with eligibility for the services limited to receipt of public assistance under several titles of the Social Security Act.

Under Title XX, States were given increased flexibility to offer a wider range of services to a broader population of adults and children. The statute also included requirements regarding planning, public participation, income eligibility, and administration.

Section 2605(b)(2)(B) of the LIHEAP statute establishes the maximum income level allowed in determining LIHEAP eligibility as the greater of 150 percent of the poverty level or 60 percent of a State's median income.

HHS releases $187.4 million to states to help offset energy costs for low-income households.

Outline of Model CSBG State Plans:

  • Grantees must complete an application for CSBG funds.
  • The application requires an annual or biannual plan for the expenditure of these funds.
  • The following assurances must be adhered to in the formulation of the CSBG plan.
  • All applications are reviewed against these assurances.  (Failure to provide an assurance can delay or even deny funding.  These assurances are embodied in the CSBG legislation and are therefore mandated by the Congress).
