This Program Instruction provides information to TANF agencies to clarify the appropriate application of 409(a)(7)(B)(i)(II)(aa) of the Social Security Act (the Act) and 45 CFR 263.5(b), commonly known as the “new spending test,” which limits a state’s ability to count state maintenance-of-effort (MOE) expenditures for certain programs that existed in fiscal year (FY) 1995 to the amount that exceeds the FY 1995 expenditures.

This PI reminds TANF jurisdictions that federal Temporary Assistance for Needy Families (TANF) and Maintenance-of-Effort (MOE) funds cannot  be used to provide juvenile justice services.

This Program Instruction addresses the change in the time-limited exemption period applicable to Afghan special immigrants. The Afghan Allies Protection Act of 2009 changed the time-limited exemption period from 6 months to 8 months. The 8 month exemption period for Iraqi special immigrants remains in effect per section 1244(g) of the NDAA 2008), enacted January 28, 2008.

This program instruction clarifies the general rule for determining the start date of the 3-year record retention period provided under 45 CFR 92.42(c)(1) as it pertains to the State, Territorial, and Tribal Federal TANF awards, and MOE expenditures.
